Agreement and eligibility
By creating an account or using Berrylist, you agree to these terms. You must be at least 18, provide accurate information, keep your account secure, and use the marketplace lawfully. A person submitting or managing a business listing confirms that they are authorised to act for that business.
Provider responsibilities and trader status
Providers list on Berrylist in trade as independent businesses. They are responsible for their services, pricing, availability, qualifications, licences, health and safety duties, insurance, taxes, and listing content. Listings must be truthful, current, and must not infringe another person’s rights. Providers confirm they own or have permission to use every name, logo, photograph, description and other item they submit.
Licence for provider content
A provider grants Berrylist a non-exclusive, worldwide, royalty-free licence to host, copy, resize, crop, format, display and distribute content the provider submits, only as reasonably needed to operate, secure and promote that provider’s listing and the Berrylist marketplace. The licence lasts while the content or listing is active and for a reasonable backup and legal-retention period after removal. The provider keeps ownership of its content and may request removal subject to legal and operational retention requirements.
Independent and unclaimed directory listings
Berrylist may independently publish an unclaimed directory listing using accurate, publicly available business information. These listings are clearly labelled and do not mean the business has joined, partnered with, verified, approved or endorsed Berrylist. Business names and logos identify the listed business only and do not represent a commercial relationship. Unclaimed listings do not accept Berrylist enquiries, reviews, availability or pricing. An authorised representative may request ownership review, correction or removal through our contact page.
Enquiries and provider services
Berrylist helps customers discover and contact businesses. Any service agreement, scheduling, deposit or payment is arranged directly between the customer and provider. Berrylist is not a party to that agreement.
External resources and affiliate links
Berrylist may recommend optional third-party products or services that could be useful to customers or providers. Some clearly labelled links are affiliate links, which means Berrylist may receive a commission if you purchase through the link without increasing the price charged to you. Recommendations are general information, not professional advice, a guarantee, or a requirement for using Berrylist. The external provider is responsible for its own product, eligibility, pricing, privacy and terms.
Advertising and campaign measurement
Berrylist may advertise the marketplace through third-party services and use measurement technologies to understand campaign performance and attribution. Advertising measurement does not change the price or terms offered to customers or providers. The information collected, the providers involved and the choices available to you are explained in the Privacy policy. External advertising platforms operate under their own terms and privacy policies.
Provider subscriptions
Starter is a 30-day free trial of the Standard listing and requires a valid payment card through Stripe. Unless cancelled before the trial ends, Starter automatically becomes Standard at $35 NZD per month. Standard and Premium are monthly subscriptions billed in advance through Stripe. Berrylist is not GST registered, so no GST is charged. Subscriptions renew automatically until cancelled. Premium features require an active Premium subscription and may be restricted after failed payment, cancellation, or expiry.
Cancellations, refunds and disputes
Provider listing cancellations and refund rules are set out in the Refund and cancellation policy. Event providers must disclose their own event-service cancellation terms before confirmation. Customers and providers should first try to resolve event-service concerns directly; Berrylist may assist but is not the service provider.
Moderation, notice and content
Listings publish automatically, but Berrylist may suspend, remove, or edit the presentation of content that is misleading, unlawful, unsafe, infringing, abusive, or inconsistent with marketplace standards. Where practical, Berrylist will explain a material restriction and give the account holder a reasonable opportunity to correct or challenge it. Urgent action may be taken without advance notice for safety, security, fraud or legal reasons. Existing reviews must reflect genuine customer experiences.
Liability and consumer rights
Nothing in these terms excludes rights that cannot lawfully be excluded, including rights under New Zealand consumer law. To the extent permitted by law, Berrylist is not responsible for acts, omissions, availability, or service quality of independent providers, or for indirect loss.
Governing law and changes
These terms are governed by New Zealand law. We may update them when the service or law changes. Material changes will be communicated through Berrylist, and the updated date will appear on this page.
